NY Salt Lake 5/10/2000 Microfilm # 1004293 Page 314-316 Transcribed By Marva (Tripp) Hothan ---------------------------------------------------------------------------------------------- In the name of God amen I Milo Tripp of the town of Ogden in the County Monroe and State of New York of the age of fifty two years and being of sound mind and memory do make publish and declare this my last will and testament that is to say. First I give and bequeath to my mother Sarah Crammer the sum of one hundred dollars To my Brother Isaac Tripp the sum of fifty dollars To my Brother John Tripp the sum of fifty dollars To my Brother Benjamin Tripp the sum of One hundred dollars To my Niece Lydia Ann Stone fifty-dollars To my Brother James Monro Tripp the sum of one hundred dollars and to my Brother William Tripp the sum of one hundred dollars Also I give and bequeath to my Brother William Tripp my trunk and wearing apparrel or so much thereof as shall amount to no more than the sum of one hundred dollars of which said Legacies I direct-that to my Mother Sarah Crammer and my Brother William Tripp their said Legacies be paid within one year after my decease. And lastly I do hereby nominate and appoint Carter Evans of the Town County and State aforesaid to be the executor of this my last will and testament hereby revoking all former will by me made In witness whereof I have hereunto set my hand and seal this 23d day of December 1861. Milo Tripp (LS) The above instrument consisting of one half sheet was at the date thereof declared to us by Milo Tripp the testator therein mention to be his last will and testament and he at the same time acknowledged to us and each of us that he had signed and sealed the same and we thereupon at his request and in his presence and in the presence of each other have signed our names thereto as attesting witnesses. Be it remembered that at a Surrogates Court held at the City of Rochester in and for the County of Monroe on the 4th day of May 1863. Present Alfred. G. Mudge Surrogate of said County the last will and testament of Milo Tripp late of the town of Ogden in said County deceased of which the preceding record of will is a true copy was duly proved and admitted to probate after citation for that purpose had been duly issued to all persons entitled to service and the said citation served returned and filed according to law and the following depositions of the witnesses were thereupon taken and filed to establish the execution genuineness and validity of said will. County of Monroe Surrogate Court In the matter of proving the will of Milo Tripp Deceased County of Monroe vs Benjamin F Emmons and Isaac Simmons of the town of Ogden in the County of Monroe aforesaid being duly sworn do depose and say that they are the subscribing witnesses to the last will and testament of Milo Tripp late of the town of Ogden in the County of Monroe aforesaid deceased And these deponents further say that the said Milo Tripp the said testator did in the presence of these deponents subscribe his name at the end of the instrument which is now shown and exhibited to these deponents which purports to be the last will and testament of the said Milo Tripp and which bears date on the 23d day of December in the year of our Lord one thousand and eight hundred and sixty one And these deponents further say that the said testator did at the said time of subscribing his name as aforesaid at the end of the said will declare the said instrument so subscribed and now exhibited to be his last will and testament and these deponents did thereupon subscribe their names at the end of the said will as attesting witnesses thereto in the presence and at the request of the said testator And these deponents further say that at the said time when the said testator so subscribed his name to the said last will as aforesaid and at thetime of these deponents subscribing their names as attesting witnesses thereto as aforesaid the said testator was of sound mind and memory of full age to execute a will and was not under any restraint And that the said will now appears in all respects as when so executed without any alterations whatsoever Isaac Simmons Benj.
